1. Acceptance
By creating an account, purchasing a license or installing the WIN Weather Bot desktop application ("the Software"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
2. The service
WIN Weather Bot is an automated desktop trading application for Windows that interfaces with the Polymarket API on your behalf using credentials you provide. The Software runs on your own machine. We provide forecast data and ensemble probabilities; we do not custody your funds.
3. License grant
Upon successful payment we grant you a non-exclusive, non-transferable, revocable licence to install and run the Software on the number of machines included in your subscription tier (typically one) for the duration of your active subscription. The Software remains our intellectual property.
4. Eligibility & restrictions
You agree that:
- You are at least 18 years old and legally capable of entering this agreement in your jurisdiction.
- You may only use the Software where Polymarket itself is accessible and legal. The Software is geo-blocked at the API level in jurisdictions where Polymarket is not available (including the United States and sanctioned countries).
- You will not reverse-engineer, decompile, redistribute or resell the Software.
- You will not share your account or licence key with third parties. Each licence is bound to a hardware fingerprint.
Geographic restrictions — Polymarket availability
WIN Weather Bot interfaces with Polymarket's API and cannot function where Polymarket itself is inaccessible or prohibited. Polymarket operates under its own separate terms and geographic restrictions, which may change at any time without notice to us.
The following jurisdictions are known to restrict or prohibit access to Polymarket as of the effective date of these Terms. This list is indicative and may be incomplete:
- United States (including all territories and possessions)
- United Kingdom
- Canada
- France
- Cuba
- Iran
- North Korea (Democratic People's Republic of Korea)
- Syria
- Russia
- Belarus
- Any other territory subject to OFAC, EU or UN financial sanctions
By subscribing, you represent that Polymarket is legally accessible in your country of residence and that you have independently verified this before purchase. WIN Weather Bot bears no responsibility for subscriptions purchased from restricted jurisdictions.
5. Subscription & payment
Subscriptions are billed in advance at the rate shown on the pricing page (Monthly, Quarterly, Semi-annual or Annual). Payment is processed by CoinGate (CoinGate UAB) via cryptocurrencies, in accordance with their Purchaser Terms of Service. Prices may change with 30 days notice; ongoing subscriptions retain their original rate until renewal.
6. No refunds — right of withdrawal waiver
Under EU Directive 2011/83/EU (consumer rights), digital content delivered immediately upon purchase is subject to a right of withdrawal of 14 days — unless the consumer explicitly waives it and acknowledges loss of that right.
By proceeding to download or activate the Software, you expressly waive your right of withdrawal and acknowledge that the Service is provided immediately and that, accordingly, refunds are not available after activation. We will refund only in cases where we, as the supplier, materially fail to deliver the Service.
7. Disclaimer of warranties
The Software is provided "as is" and "as available". We make no warranty — express or implied — that the Software will be uninterrupted, error-free, profitable, or that it will detect every market opportunity. Weather forecasting is inherently probabilistic and prediction-market trading involves substantial risk of loss, including total loss of capital.
The Software is a tool, not financial advice. All trading decisions and their consequences remain solely yours.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from or related to your use of the Service shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential or punitive damages, including trading losses, missed opportunities, lost data or reputational harm.
Nothing in these Terms limits our liability for fraud, intent or gross negligence as those concepts are defined under Italian law.
9. Suspension & termination
We may suspend or terminate your account for breach of these Terms, fraudulent activity, abuse of the affiliate program, or where required by law. Termination ends your licence to use the Software immediately. Paid but unconsumed subscription time may be forfeited in cases of breach.
10. Third-party trademarks & independence
Polymarket® is a trademark of its respective owner. WIN Weather Bot is independently developed and operated; we are not affiliated with, endorsed by, or partnered with Polymarket. See the full disclaimer for details.
11. Changes to these Terms
We may update these Terms. Material changes will be notified by email to registered users at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
12. Governing law & jurisdiction
These Terms are governed by Italian law. Any dispute arising from or related to your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Italy. EU consumers retain their mandatory rights under their local consumer-protection law.
